Program Description: PPLA is an association specifically designed
to promote pain management by providing an unassailable standard
of care and record keeping; by making available consultation,
review and guidance by the finest minds in pain management;
by accessing the best available legal expertise; and by acquiring
a defense benefit program for the association that will provide
up to $500,000 of legal defense for each member who
is forced to defend against regulatory actions by the DEA,
state boards of medical examiners and other agencies.
Statement
of Need: Physicians whose practices actively involve pain
management are particularly vulnerable to merit less actions
arising from the prescription of opioid pharmaceuticals. Defense
of such actions is enormously expensive - easily running into
hundreds of thousands and even millions of dollars - and frustrating
to physicians who often have nowhere to turn for assistance
and support.
"Riders"
adding coverage to conventional professional liability policies
typically provide only nominal limits in the range of $25,000,
and do not necessarily offer the physician access to risk
and claims management resources specific to the nature of
the practice. Beyond pain management, statistics suggest that
physicians in general are increasingly subject to actions
against their licenses.
PPLA is
established as an association to promote the highest standards
of pain management.
Related to the promotion of pain management, PPLA has a defense benefit program from world-class London underwriters
to pay for legal defense against drug-related prosecutions
of physicians. Physician members of the Association have the
option of exercising this protection as a benefit of their
membership in the Association.
Association Form and Limits:
Coverage is offered on a claims-made basis, with a maximum
limit of $500,000 per "event." This defense benefit applies only to claims first made against the member during the membership period, if such claims are reported to the Association during the membership period. Warranted that the member complies with the following:
-The provision of standard of care
-The provision of standard of record keeping
Annual aggregate
limits will apply on both a per policy and program basis.
The defense benefit will provide the members coverage
for the costs of defense, monetary fines and penalties for
Administrative Disciplinary Proceedings, as well as reasonable
Consultation Expenses associated with an investigation of
the physician's professional conduct. PPLA membership is $2400.00 annually.
